Legal Dispute Over MetaBirkin NFTs Tied to Hermès Continues
Judicial Decree Halts NFT Showcase
The saga took a fresh twist when Judge Jed S. Rakoff of the U.S. District Court issued a definitive ruling with a permanent injunction, effectively halting Rothschild’s alleged trademark transgressions regarding Hermès.
More recently, Rakoff has extended this prohibition by preventing the MetaBirkins assets from being exhibited at Stockholm’s Spirit Museum. Such a decision followed Rothschild’s request for legal clarification on exhibiting despite the prior court verdict.
In his latest remarks, Rakoff openly branded Rothschild a “straightforward swindler”, with the NFT creator disputing this accusation.
Looking ahead, Rothschild continues to challenge the court ruling of the prior year, and an appeal is still underway in the Second Circuit Court of New York.
Rhett Millsaps, Rothschild’s attorney, is set to advance a motion for reconsideration, signaling the next chapter in a legal saga that questions the limits of artistic NFTs and corporate branding.
